- Nutrition values and macro calculations are provided for informational purposes only and may not be 100% accurate.
- The Services are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease.
- If you have a medical condition or dietary needs, consult a qualified professional.
CSoftware, firmware, and updates
- We may provide updates, patches, or changes to improve performance, security, or features.
- Some features may require internet connectivity and may change or be discontinued over time.
DData collection from the scale and mobile application
When you use ScaleMyPlate products and the ScaleMyPlate mobile application, we automatically collect usage and measurement data, including weighing activity, food logging, and app interactions. All data collected is anonymized: it is not linked to your name, email address, or any other information that could directly identify you as an individual.
This anonymized data is collected from both the ScaleMyPlate food scale hardware and the ScaleMyPlate mobile application (including any version of the app that links or redirects to these Terms). It is used to improve product performance, enhance nutritional accuracy, and develop new features.
By using the scale or the mobile application, you consent to this anonymous data collection. For full details on what is collected and how it is handled, see our Privacy Policy.
07Accounts and user responsibilities
- If you create an account, you are responsible for maintaining the confidentiality of your login credentials.
- You agree that information you provide to us is accurate and up to date.
- You are responsible for all activity that occurs under your account.

Our collection and use of personal information (including anonymized data collected automatically through the ScaleMyPlate food scale and mobile application) is described in our Privacy Policy. If you accessed these Terms from the ScaleMyPlate mobile application, this Terms of Service and our Privacy Policy govern your use of the app in the same way they govern use of our website and hardware products.
13Disclaimers
To the fullest extent permitted by law, the Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14Limitation of liability
To the fullest extent permitted by law, ScaleMyPlate and its affiliates, officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of (or inability to use) the Services or products.
15Indemnification
You agree to indemnify and hold harmless ScaleMyPlate from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.
16Termination
We may suspend or terminate access to the Services at any time if we believe you have violated these Terms or if needed to protect the Services, users, or our business. Sections that by their nature should survive termination will survive (including disclaimers, limitation of liability, and indemnification).
17Governing law
These Terms are governed by the laws of Canada and, where applicable, the laws of the province/territory in which ScaleMyPlate is established, without regard to conflict-of-law rules.
